Introduction How many times do you drive your car, and just when you are about to approach the intersection or the stop sign, you begin to notice a pair of eyes staring at you? You realize these are not just eyes, but these eyes are to a person who is down on his luck. You cannot begin to understand what tragedy has fallen on this unfortunate soul, but you can see a glimpse of sadness through their eyes. Physically, this person barely has a shoe on, clothes are ripped, smells of sweat and blood, seems like they have not taken a shower in months and yet it is not the physical appearance that catches your attention; rather, it is the heavy burden that seems like a boulder which is weighing down those sad and dim eyes. What do you do? Do you get out and ask the person, what can I do for you today? Can I buy you lunch? Or better yet, can I buy you some clothes? No, if you have a sense of decency, you would try to reach in your pocket or your compartment filled with change in the car and take a handful and give it to the person waiting on the side of the street. Or, do you pretend to not even see them, and think if you ignore what is in front of you, then those people and their problems would cease to exist? Enterprises with appropriate technology are having a definite advantage over the others in the competitive business environment. Therefore enterprises should have very clear understanding of their technology needs and opportunities. Many telecommunications service providers in the world are in the midst of undergoing technical and structural changes, whilst at the same time experiencing major growth. Competition and rapid technological advancements drive the present telecommunications industry. In Sri Lanka Mobile Communication Industry is rapidly growing. The economy having achieved sustained growth over three decades averaging nearly 5% per annum, in conjunction with a modest population growth in comparison to other South Asian countries crossed the USD 2000 mark in per capita income. Notwithstanding conditions of uncertainty, investment in infrastructure development continued at the macro level and Mobile Communication industry has achieved a considerable growth. The economic realities and new market developments during the last year turned out to be a stress test for all mobile phone operators in Sri Lanka. Ruptures emerged and the industry had to search for quick but durable fixes to remain viable. The entry of the fifth mobile phone operator, early in the year set the new reference price and forced a downward revision of pricing by all mobile operators. This caused a sharp reduction of the reference price by approximately 50%. Further to cutting prices, competition in the industry intensified and this resulted in a sharp rise in advertising and promotional activity. The combined effect of a significant drop in prices and high promotional costs compelled most industry players to consider serious adjustments to their business models and structures, a process that led to job losses in the industry. Leading operators recorded some growth in business volume in a growing market, but declining margins eroded revenue bases leading to operating losses. 1. 1 Objectives Main objectives of this repot are; 1. This framework is based on the value chain concept, which identifies the primary and support activities of a telecommunications service provider, and uses step by? step procedure to analyze the technological capability needs in these activities and to develop indicators to measure the extent to which such technology capabilities have developed. 2. 1 History Although telecommunication has a history of more than 150 years in Sri Lanka, the island’s mobile communication history extends to less than 25 years. Mobile phone technology first evolved in 1946 after the Second World War. The first Mobile network was established in North America. After 42 years, mobile technology was introduced to Sri Lanka. The first private mobile operator to enter the market in 1989 was Celltel Lanka Limited, which was later known as ‘Tigo’. In 2009 Tigo was acquired by Etisalat; Middle East telecom giant. The first mobile operator based its services on the E? TACS technology which offered basic voice services to Sri Lankan subscribers. Between 1989 to 1994 the Government took measures to introduce competitive cellular services by granting license to three mobile operators; OTC Australia (Pvt. ) Ltd, presently known as Mobitel (Pvt) Ltd, MTN Networks (Pvt. ) Limited, commonly known as Dialog GSM, and Lanka Cellular Services (Pvt. ) Limited currently known as Hutch. In 2009, the Government introduced more competition to the market by granting license to a fifth mobile operator, Bharathi Airtel which is an Indian telecommunication giant. From 2004 to 2010 Mobile communication industry in Sri Lanka had an annual growth of around 35? 40%. 2. 2 Assessing Technology Level World Technologies in Telecommunication is shown in Table 2. 1. It has been introduced in 1992 as a 2nd generation technology but by 2010 it’s enhanced with development of GPRS and EDGE technologies. As still GSM technology has more than 80% of world subscriber base and GSM is enhancing with support technologies it is expected to last more years. 3G/3. 5G (WCDMA/HSPA) are most modern commercially available technologies. It’s seen that these technologies are capturing the market rapidly. According to related surveys, more than 96% of WCDMA networks have deployed HSPA, with the majority (over 52%) supporting a peak downlink data capability of 7. Mbps or higher. With 22% of HSPA network operators committed to HSPA Evolution (HSPA+). According to the table Dialog and Mobitel have latest technologies comparing to other operators. When comparing with the World status Sri Lankan Operators are using state of art technology. Also Sri Lanka is the first country which demonstrated HSPA+ in South Asia. Page 6 Mobile Communication Industry in Sri Lanka 3 Technology Problems Recent years were probably the most challenging for the mobile communication industry in its history. Economic and industry turbulence heightened and industry leaders were forced to absorb the shocks in telling proportions while weaker operators were rendered vulnerable. The mobile communication industry deserves commendation for surviving trying economic, industry and regulatory challenges and for riding the tide. However, the cumulative effect was an entire mobile communication industry reporting operating losses. Following are some performance data of Mobile Operators in year 2009. Dialog Group reported negative NPAT of 1159 mill. Without recurring costs. In operation Etisalat reported a loss of approximately ~1600 mill. Hutch turn over was decreased by 61. 9% Mobitel reported a net loss of Rs. 395 mill. As margins become narrower and narrower operators are needed to find new opportunities in order to enhance revenue. But several technological problems are there as barriers for growing Mobile Communication Industry. 3. 1 Capacity Limitations In Mobile communication data traffic demand is rapidly increasing. Major bottle neck in providing higher data rates is limitations in transmission networks. Currently Mobile operators have not island wide optical fiber networks in order to provide higher capacities. Also to provide higher capacity at low cost, traditional TDM based access networks are a barrier. So IP based networks need to be deployed. For this huge investments are needed but current financial status of all mobile operators is not healthy enough for that. Currently it is not possible to provide higher data rates when users move from UMTS (3G) coverage area to GSM/EDGE coverage area. Page 7 Mobile Communication Industry in Sri Lanka Currently the number of users can be catered by one cell has become a issue in mobile industry, because if there are more than possible no of users in the same cell, Users experience the congestion situation and as a result this cell need to be further brake in to two cells or covered by an umbrella cell to cater the capacity. When doing so different frequencies need to be assigned to the different cells and this will increase the interference to the users and quality would be dropped. 3. 2 Energy Issues In rural villages in Sri Lanka, electricity is either not available or is available only in limited quantities. As a result, even if battery backup is provided for the Base Stations (BTS), the batteries do not get fully charged. Further, due to frequent interruptions in the power supply, the life of these batteries gets shortened, which in turn increases the operational cost to run services in rural areas. Unavailability of reliable power in semi? urban, rural and remote areas increases operational costs further because sufficient backup systems have to be maintained. Therefore sustainable green energy sources are essential to have need in future. But still in Sri Lanka Green Technologies like solar energy and wind power energy are not popular in Mobile industry. Also existing such technologies are not capable of successful operation of base stations. Unavailability of commercial power in rural areas is also affected to mobile operators to expand their coverage. Optional power sources are needed to expand coverage in small time duration with minimal cost. 3. 3 Frequency Spectrum Issues In Sri Lanka Super High Frequency (SHF) Band is highly polluted. SHF band includes frequencies between 3GHz and 30 GHz. In this band more than 10000 Microwave Links are currently operating. Especially in urban areas it is difficult to deploy new back bone microwave links due to interference. This has highly influenced for providing enough data capacity for Mobile Broad Band customers. Page 8 Mobile Communication Industry in Sri Lanka TRCSL has not allowed Point to Multi? Point backhauling technologies for telecom operators. With this technology number of microwave links need to be installed can be reduced and operators can easily deploy their back hauling networks. 3. 4 BSC/MSC Boarders In early mobile systems, remote base station sites were controlled by the MSC or mobile switching center. But with current systems under 2. 5G GSM network BSC Base station controller controls the remote Base stations and under 3G network RNC Radio Network controller controls the remote node B sites, because of this scenario, It is a must to have several BSC/MSC boarders in the network and when users are moving via this boarders, the probability of drop of the calls are vey high reducing the network quality in those areas. For example, people in the boarder areas always experience call drops and bad call quality etc. Therefore improvement for this is necessary via the advancement of the technologies. It may be high capacity MSCs or BSCs or some other solutions. 3. 5 Tower Loading Microwave links are used as the main means of backhauling in mobile industry in Sri Lanka and these microwave links need to be fixed on towers with having line of sight. Usually each tower connects with more than one tower therefore always several links are need to be installed on a tower top. If its a hub site this number may increase to 10? 15 even more than 50 sometimes. Microwave antenna comes with 0. 6/1. 2/1. /2/2. 5m diameter; therefore this is a big equipment. Also it has a larger wind shield area, because of this big size and area and weight operators need high strength large towers to be implemented. If the antenna sizes and weight of this microwave links can be decreased it would be quite advantageous for the operators. Else new technologies like laser links, IR Links or smaller antenna sized IP links technolo gies can be developed to be able to guarantee the same level of availability. Then operators would be able to replace heavy microwave and use light equipment types. Page 9 Mobile Communication Industry in Sri Lanka 4 Proposed Technologies 4. 1 Fiber Based Transmission Fiber based transmission is not a new technology in the industry. In Sri Lanka SLT and Dialog have their own fiber based networks. Fiber based transmission can cater quite high capacity data transmission. It can be used to implement either TDM/SDH based network or Packet/IP based network. Although SLT has a island wide fiber network, Dialog fiber network is still not widely spread. In fiber based solutions fiber cables are drawn from core network sites to the remote Node? B/BTS sites. Usually a ring topology is used and it goes via hub sites, from hub sites fibers are drawn to remote sites. Figure 4. 1: Typical Fiber Based Mobile Network The problems with Fiber based transmission is the high initial capital investment cost and the time taken for the implementation. Most of the operators are not capable of affording such investment for their own fiber based infrastructure. Page 10 Mobile Communication Industry in Sri Lanka If a fiber network can be used for providing transmission for base stations, increasing data traffic demand can be easily fulfilled. Another option is to lease fiber network’s capacity from already deployed SLT or Dialog network. But leasing cost need to be highly considered. 4. 2 IP RAN Implementation of IP RAN (IP Radio access network) is the key to provide higher capacity. An IP ran with higher capacity to remote sites can reach higher speeds with currently available HSPA+ like technologies. Figure 4. 2: HSPA Technology Roadmap According to the roadmap shown in Figure 4. 2, with the enhancements of HSPA+, Wimax /ADSL speeds can be passed or equalized with HSPA in the years to come. The IP radio access networks (IPRAN) consist of end to end (Remote sites to the core network nodes) transmission with IP/Ethernet networks. Easiest way to implementation of such a technology is fiber based IP network where higher capacity and less complexity can be achieved. 4. 3 EDGE Evolution for GSM Current 2G networks are inadequate for providing data speeds of GSM/EDGE networks. EDGE Evolution quadruples standard EDGE network speeds, promising downlink data Page 11 Mobile Communication Industry in Sri Lanka rates of 1. 2Mbit/s, though the standard has headroom for up to 1. 9Mbit/s. Similarly, uplink data rates of 474kbit/s are expected, although the standard specifies 947kbit/s. 3GPP standardized EDGE Evolution in 2007 (3GPP Release 7). 4. 4 Green Technologies Maintenance costs of networks in rural areas are high compared to urban areas, because of several factors such as poor transportation systems, difficulty in supply of spare parts and non? availability of skilled manpower. Due to lack of reliable power in rural areas, there has been a substantial increase in the usage of diesel for running engine alternators to keep telecom switching centers, transmission equipment and BTS s up and running. Currently more than 5000 Communication towers are there in Sri Lanka. This increases costs substantially. In spreading the reach of telecommunications in remote areas, renewable energy should be used to power relay towers in remote areas. By replacing diesel generators with solar panels in cell phone towers, tons of carbon emissions could be prevented from entering the atmosphere. Also, the maintenance cost for the operation of solar equipment is comparatively lower as compared to diesel generators operated BTS towers. Solar generators have no carbon emissions and also help in preserving the environment for sustaining life on earth. It reduces global warming, as carbon emissions are null in solar devices. The manpower needed for the operation and maintenance for solar equipment do not require extra skill. The telecom majors in world have started operating mobile repeater and relay stations, which harness solar and wind energy with the wind turbines foisted on the telecom towers. The hybrid systems, involving solar photovoltaic systems and wind energy installations for this application assure uninterrupted supply of 2. 8 kilowatts of power daily. A master control installed at the site acts as a voltage stabilizer, while a generator has been kept as a back? up for charging the batteries in case of emergency. Though the diesel generators are the lifelines of telecom towers, they contribute to significant carbon emissions. Going green and pushing the use of alternative energy sources like solar, wind and bio? fuel is the need of the hour; the government should provide high subsidies to help the telecoms taking this step, quickly and easily. Going solar is the way forward. Therefore as we can see above technologies are the candidate technologies for future enhancement of Mobitel network. According to the study these technologies can solve the main issues that were identified in this chapter. Therefore a strategy and a roadmap are required for timely implementation of the technologies in the network. 4. 5 LTE LTE (Long Term Evolution) is a 4G technology which is emerging in the world now. When existing technologies are becoming obsolete, investments need to be done on new technologies. It is assumed that 2G will become obsolete in near future. It can be seen the technology is mainly improved focusing the deliverable capacity. See Figure 4. 5. By introducing green technologies operational cost can be reduced. Therefore a huge advantage can be taken in current price war. With low cost IP based technologies and Point to Multi Point Backhauling technologies can be reduce operation and maintenance cost also. Going for Fiber Networks can help to reduce operational cost by reducing huge TRCSL license charges need to be pay annually for Microwave Links. With those technology improvements turn over can be improved and hence investments can be encouraged because huge investments are needed in near future as Core Mobile Technologies are evolving day by day. Government need to be given intensives for investments in Mobile Technologies as it can energize the economy in return. Above mention technologies can reduce the environmental problems raised by Mobile Industry. Some of such issues can be listed as follows. Carbon Emission of more than 5000 Base Stations island wide Radio Frequency Pollution Currently Mobile Industry has influenced in culture also. Wide spread of pornographic contents is a major issue. Now recently all mobile operators have been agreed to implement technological measures to filter out such contents. Therefore by introducing mentioned technologies mobile operator will be able to overcome technological barriers as well as financial issues, marketing issues and environmental uses etc. Although Sri Lankan Mobile tariffs are the lowest in the region, customers are not satisfied with the service in general. Commercial Law Negligence

Question: Discuss about theCommercial Lawfor Negligence. Answer: Introduction Negligence is a civil wrong done and is considered as a tort. The basic idea behind negligence is that a reasonable care should be exercised by people, when they do any act so that no foreseeable harm is caused to the other people. In the following parts, the concept of negligence has been applied in the given case study Issue Whether Tamara can successfully sue Aldi Supermarkets in negligence for her losses, or not? Rule When a person fails to exercise the necessary care, which was owed by that person to some other person, and this failure results in injury or harm to the other person, then the first person is guilty of committing the tort of negligence. In order to establish the necessary care, the actions of a reasonable person, in similar circumstances, would have to be ascertained. In case negligence is established, the aggrieved party can claim for damages, in form of monetary compensation (Legal Services Commission, 2016). In order to establish that negligence was present, the elements of negligence have to be established. These elements include a duty of care, a breach of this duty, remoteness, and the injury or harm. The breaching party should have owed a duty of care towards the aggrieved party (Legal Aid, 2015). To establish this, the landmark case of Donoghue v Stevenson [1932] UKHL 100 has to be taken as an example. In this case, a snail was found in the bottle of the ginger beer that Mrs. Donoghue was drinking and she sued the manufacturer Mr. Stevenson for negligence. In the judgment, the judge held that the manufacturer owed a duty of care to its users and hence, was held liable in negligence (British and Irish Legal Information Institute, 2016). Along with this, it also has to be established the loss was foreseeable (The Law Handbook, 2015). In case the loss is such, which was beyond what could be expected then the person cannot be held liable in negligence. In the case of Overseas Tankship (UK) Ltd v Morts Dock and Engineering Co Ltd [1961] UKPC 2, also known as Wagon Mound (No. 1), the judges held the judges held that the loss was not foreseeable and hence, the damages were not recoverable (Case Briefs, 2016). The next essential is the breach of duty of care. When the breaching party fails to exercise the duty of care, which was owed, and who fails to recognize the substantial risk of loss, then such party breaches the duty of care. In order for a party to be held liable, it has to be shown that the actions of the breaching party resulted in the loss to aggrieved party. Moreover, it has to be established that the party was in proximity to cause the harm to the other party (Latimer, 2012). The last essential deals with the injury or loss. Unless and until a loss, harm or injury is shown by the aggrieved party, the negligence would not be established. Along with this, the loss has to be significant or substantial to claim against the negligence. In case the loss is too remote, and all the essentials of negligence are present, the damages would not be awarded to the aggrieved party (Latimer, 2012). Contributory negligence is a defense that is taken by the breaching party in case of negligence. As per this, when a person fails to apply the duty of care upon them, and contributes towards the loss or harm that resulted from a negligence of the other party, then such party contributes to the loss, and accordingly, the damages of the breaching party are reduced (Latimer, 2012). In the case of Davies v Swan Motor Co [1949] 2 KB 291, Davies was held liable for the damages caused as he was negligent in standing on the side of the lorry, and the damages were reduced accordingly (E-Law Resources, 2016). In one of the recent cases of Raad v KTP Holdings Pty Ltd as Trustee for VM KTP Nguyen Family Trust [2016] NSW 2016 888, the plaintiff slipped on the wet tiles and was injured, so the plaintiff sued the defendant for negligence. The defendant could not show that efforts had been made to make the floor dry and non-slippery. The speed of plaintiffs movement was claimed by the defendant as a contributory negligence. But, the defendant was held to be negligent and only 10% of damages was reduced as a result of contributory negligence on part of the plaintiff (Devitt, 2016). Application In the given case, Aldi Supermarket was claimed to be in negligence by Tamara. As per Tamara, the store owed a duty of care towards her, which they failed, and which resulted in her back injury and hence, claimed for damages. The elements of negligence were present in this case, as there was a duty of care, a breach, remoteness and harm to Tamara. So, Aldi Supermarket committed the tort of negligence. But, Tamara was aware that the floor was wet, and in an attempt to get the chocolate bar, she ran towards it, after seeing another person approaching the chocolate bar. By running, she contributed towards the negligence of the Aldi Supermarket. Moreover, as against the case of Raad v KTP Holdings Pty Ltd as Trustee for VM KTP Nguyen Family Trust, which is quite similar to this case, the supermarket could show that the floor was cleaned every 45 minutes, to fulfill their duty of care. By foreseeing the risk of an individual slipping due to the wet floor, the supermarket ensured that it fulfilled its duty of care. Conclusion From the above analysis, it can be concluded that Aldi Supermarket indeed committed the tort of negligence, but at the same time, Tamara contributed towards the loss and hence, contributory negligence was present. But, Aldi Supermarket could show that they had taken the necessary steps to ensure that no harm was caused due to the foreseeability of a person slipping on wet floor, and hence, fulfilled the duty of care. So, the Aldi Supermarket did not commit negligence. And even if Tamara initiates court proceedings against Aldi Supermarket for negligence, she would fail in getting any damages due to her contributory negligence. So, it is advised to Tamara, to refrain from suing Aldi Supermarket, as firstly, they did not commit negligence, and secondarily because she would be held guilty of contributory negligence. Regardless of this guilt, Macbeth continues to murder numerous people resulting in the motif, blood, appearing again. In Act five Scene one, Lady Macbeth begins to experience suppressed guilt as well when she starts to sleep walk. While Lady Macbeth sleep walks she talks to herself and continuously rubs her hands in a washing motion in order to get rid of the blood only she can see. Similar to the â€Å"dagger† soliloquy, Lady Macbeth’s sleepwalking scene can also be considered a part of the motif appearances vs. reality since the blood she is trying to wash away isn’t there. In Act one Scene three of Macbeth, the motif darkness is the third motif presented. Throughout the entire play, with the exception of Act one Scene six, darkness was the main â€Å"setting†, providing the play with an ominous and eerie mood. One can deduce that this motif was also used to unsuccessfully shield the evil doings of Macbeth and Lady Macbeth. Darkness is first introduced or inferred to when Macbeth states that the weather was horrible in Act one Scene three. Darkness is also presented in Act one Scene five when Lady Macbeth calls on darkness to shield all eyes to her wicked acts. In Act two Scene four, it is made apparent that Darkness has come along with other abnormalities after Duncan was killed when Ross says, â€Å"By Th’ clock ‘tis day/ and yet dark night strangles the traveling lamp: Isn’t night’s predominance, or the day’s shame/ That darkness does the face of the earth entomb/ When living light should kiss it? † (II. iv, lines 6-9). Although darkness was called by Lady Macbeth for protection, it eventually turns against her, making her afraid of the darkness. This can be deduced because of the constant candle she carries around while sleepwalking in Act five scene one. One can also deduce that in the final scene and act of the play, the darkness that has plagued Scotland disperses with the death of Macbeth and Lady Macbeth. Throughout the Shakespearean tragedy Macbeth, motifs play a central role as a way to display important actions, scenes, and lines. The three motifs, appearances vs. reality, blood, and darkness, are the most prominent motifs since they add structure and entirety to the play. The Investigation Into the Death of Jill Dando Essays The Investigation Into the Death of Jill Dando Essay The Investigation Into the Death of Jill Dando Essay On 26th of April 1999, TV presenter Jill Dando was shot in the side of her head with a modified gun at close range, on the doorstep in front of her house on Gowen Avenue. A neighbour, Helen Doble, who originally thought Dando had been stabbed, found her body, who subsequently called the emergency services. Jill Dando was taken to Charing Cross Hospital nearby, yet was declared dead on arrival. Operation Oxborough was established, a two year long investigation. Police were initially bombarded with information that bore no evidence or leads for the investigation, for which extra staff and resources were needed. While nobody appeared to have witnessed the crime, many came forward with sightings of men near the scene around the time of the crime. The first suspect was a man who had waited at the bus stop on Fulham Palace road, boarded a bus, yet got off before his supposed destination. Witnesses say that this man was sweating and looked agitated. Police learned that Jill Dando had been shot around 15 minutes previously, and therefore the sweating man became their first suspect. The man was described as 59 to 510, medium build in his late 30s, having a round face, dark complexion and being clean shaven. However, after producing the following E-fit, police began to realise that perhaps this man was not their murderer, but may have been a witness. 1 The E-fit of the sweating man The sweating man never came forward. After this line of enquiry fell through, the police began to interview anyone associated with Jill Dando. This was an extensive line of enquiry as the police searched through and contacted almost 500 people listed in her filofax, examined around 14,000 emails sent to the BBC and examined all her letters and phone messages. Following this, a Range Rover had been singled out as it failed to stop at a red light shortly after the murder, in Fulham. In the process of tracking this car down, police also investigated the details of 1200 vehicles. The case had barely progressed for 6 months, counting a list of 2000 suspects. Police then contacted profiling experts in the United States, who suggested that the crime was more likely to have been committed by an obsessive stalker. This helped to narrow down the list of suspects from 2000 to 140, those of whom had an unwholesome interest in Jill Dando. They began to concentrate on a man who they had received messages about in the days after the murder, called Barry George, who lived 800 yards away from Jills home, and was described as an oddball. Following a surveillance operation, his flat was searched three times where they found circumstantial evidence such as newspaper clippings, and what may have possibly been gunshot residue, linking him to the murder. By May 2000, Barry George was arrested and charged with the murder of Jill Dando, despite his alibi. The police then began to prepare witnesses for trial, conduct identity parades and continued to gather information to counter his alibi. However, Barry George has always protested his innocence, and many appeals have been turned down. Barry George originally came under suspicion as he was acting agitated during appointments with his housing association and GP, the day of the murder. Two days later, he began asking if people could verify what he was doing the day Jill was shot. The police involved in the investigation had been told hat he was odd and owned air rifles. Much of the evidence obtained during investigation was circumstantial, and in this review the evidence will be looked at critically. * Books and magazines on firearms were found in stacks during searches of Barry Georges flat. The prosecution used this as evidence to base the claim that Barry George was a loner who was obsessed with firearms. This was also supported by the finding of a single particle of gunshot residue in his coat pocket. However, these magazines dated back to the 1980s, during the time which he had joined the TA in 1981, but left after he failed his training. After leaving he attempted to join a firearms club but was turned down. On two separate occasions he had shown a friend a gun, and fired a blank from a gun. However, there is no evidence that this interest had continued into the 90s, especially not over a period of 20 years when Jill Dando was shot. Furthermore, controversy surrounds the sole particle of GSR. The forensic scientist called as an expert witness during the trial said that after using SEM (scanning electron microscope), he was able to compare the particle with particles from a test fire using a similar bullet which was used in the murder, and he concluded that the particle found could have come from the cartridge case which was found at the scene, as they were both made up of barium, aluminium and lead. Particles found in Jill Dandos hair and on her coat were also made up of the same compounds. However, these particles may have been the same type but there was no way of distinguishing whether the particle had come from the murder weapon, as this was never found for comparison. Furthermore, the police said that when they entered the property, they had not gone in with guns. New witnesses have come forward; a retired church minister and an airport worker say that the officers were armed when they went in. They would themselves have had gunshot residue on their hands and could have easily contaminated the coat. Furthermore, these searches did not occur until a year after the murder, and therefore, it may not necessarily be gunshot residue from the murder.

It is often described as a process of internationalization easy communication regardless of geographical boundaries due to advance technologies, easy and fast financial capital flow across the globe and countries become more interdependent particularly in economy. It is believed that globalization provides consumers with variety of choices with affordable price. So, is the globalization reducing or increasing poverty? This study will attempt to briefly answer this question. Though both the United Nations and India have celebrated fifty years, they have been criticized for failing to translate the stated mandate for the disadvantaged millions. Half a century after Independence, as of now, we have the largest population of poor people in the world, one third of our rural population is below the poverty line and despite the UN agencies massive aid projects, the development assistance of the World Bank, bilateral aid, the Center and State governments intervention, the gap between the rich and the poor has doubled in the last three decades fifteen years ago the lowest 20 per cent of global population received 2.5 per cent of global wealth whereas at present, the share has been reduced to less than 1.3 per cent. For example, the 1999 UNDP Human Development Report records that the gap between the rich and the poor among nations as well as within nations has widened. Even the World Bank in its Report for 1999 concedes that raising the GNP is not enough to impr ove human development, other social measures are needed. The trickle-down theory of economic development cannot bring out the desired results. It has also pointed out that India is a country of stark contrasts and disparities. Among the widening contradictions some seem to be glaring. Undoubtedly food grain production has increased fourfold but 653 per cent of children under four remain undernourished; literacy has doubled, yet half the population is illiterate, life expectancy has improved but only 927 females survive for every 1000 males. As we have entered into the twenty-first century, it is imperative on our part to look at the scenario with bare facts and figures. The problem statement Does Globalization increase or reduce poverty. Objective and scope Poverty in India is widespread with the nation estimated to have a third of the worlds poor. According to a 2005 World Bank estimate, 42% of Indias falls below the international poverty line of $1.25 a day (PPP, in nominal terms Rs. 21.6 a day in urban areas and Rs 14.3 in rural areas); having reduced from 60% in 1980. According to the criterion used by the Planning Commission of India 27.5% of the population was living below the poverty line in 2004-2005, down from 51.3% in 1977-1978, and 36% in 1993-1994 Among the causes ascribed for the high level poverty in India are its history under British rule, large population, and low literacy. Also important is Indias social structure, including the caste system in India, and the role of women in Indian society. Economic growth has in the past been dampened by a dependence upon agriculture, and the economic policies adopted after its independence. Since the 1950s, the Indian government and non-governmental organizations have initiated several programs to alleviate poverty, including subsidizing food and other necessities, increased access to loans, improving agricultural techniques and price supports, and promoting education and family planning. These measures have helped eliminate famines, cut absolute poverty levels by more than half, and reduced illiteracy and malnutrition. Defining Globalization and Poverty Globalization has been defined in various dimensions. Among many established definitions, these are some of them. Globalization as internationalization in which is viewed as simply another adjective to describe cross-border relations between countries; Globalization as liberalization which refers to a process of removing government-imposed restrictions on movements between countries in order to create an open, borderless world economy. Defining poverty is controversial. Definition of poverty in developed countries may not be applicable to the one in developing countries. However, United Nations and World Bank define poverty line as living on less than a $1 and $2 a day for low income countries. Sociologists define poverty a lack of essential items such as food, clothing, water, and shelter needed for proper living . Since Globalization and Poverty is a huge and very broad topic, this short paper is to attempt looking at one of the heated debate questions on whether globalization reduces or increase poverty. Numerous studies on this issue have been carried out. However, the findings are conflicting. (II) Globalization Reduces Poverty Neoliberal economists widely believe that globalized trade benefits not only the affluent but also the poor through trade integration. Neoliberal economic theorymore open economies are more prosperous, economies that liberalize more experience a faster rate of progress Wade (2004, p-567). The belief is that as countries open up their economy such as by slashing down the trade barriers for instance tariff, custom duty and quotas, price of imported goods will be affordable for the poor; foreign direct investments come in and create jobs in local economy. Consequently, this increases export growth and GDP. Millions of poor peoples living standard improves because of jobs created. China, India and Vietnam are often cited as good examples for success of globalized economy. (III) Globalization Increases Poverty On the contrary, many economists are unconvinced by the neoliberal economists view that globalization reduces poverty. Pilger (2001) in his TV report on Indonesia presents that despite investments from multinational corporations (eg. Nike, Levis, Reebok Classic, Calvin Klein Jeans, Adidas, Gap Inc.), poverty remains unchanged in Indonesia. On average, Indonesian workers are paid only slightly over Rupiah 9,000 (US$1) per day which is just over half of a living wage. Harrison (2006) finds similar situation in Mexico. Mexico is a member of North American Free Trade Agreement (NAFTA) signed in 1993 with Canada, Mexico and USA. If trade integration is to reduce poverty and benefit the poor as neoliberal economists suggest, poverty in Mexico should be declined. But, Harrison (2006, p-7) concludes that poverty rates in Mexico in the year 2000 were higher than they had been ten years earlier. This reinforces that neoliberal economists view on decline of poverty is unconvinced. (IV) Other reasons contribute to poverty Wade (2004, p-571) states that more than 1.2 billion people are still living on less than US$1 a day. The followings are some of the most recognized reasons contribute to poverty: lack of natural resources, natural disaster long period of draught, corruption and sanctions imposed against specific country. For example, according to United Nations, Cape Verde is one of the most stable democratic countries in Africa and the government is relatively mild in corruption. It ranks 49 out of 179 in Transparency Internationals 2008 Corruption Perceptions Index . But due to cycles of long-term drought, lack of natural resources, shortage of water supply and lack of foreign investments, the state is still among the poorest nations on earth despite its good governance. Countries with rich endowment of nature resources also remain in poverty due to wide spread corruption, bad governance, political instability and economic sanctions imposed by powerful countries. For example, my country, Myanmar (Burma) is still among the worlds poorest countries despite rich endowment of natural resources from oil to various gem stones. It is due to political instability, severe corruption, lack of reliable judiciary system, basic infrastructures and economic sanction imposed by The US. Consequently, unemployment rate is remarkably high and chance of economic success for big majority of population is slim unless economic and political reform take place. (V) Role of World Bank, IMF and WTO on development in poor countries The World Bank, International Monetary Fund (IMF) and World Trade Organization are widely known as driving forces of trade liberalization. Pilger (2001) interviews several former executive officials of The World Bank and IMF in his TV report on Indonesia. Those officials explain that the roles The World Bank and IMF have played in Indonesias economy and various criteria a country to comply with order to get loan from them. World Bank and IMF are supposedly to help poor countries. In reality, powerful countries use the two institutions as tools to suck up resources from developing countries via multinational corporations, according to the TV report. To get loans from the institutions, a country has to reform its economy which mainly means to open up markets and allow multinational corporations to access to countrys resources and privatize industries. Thus, complying with the criteria implies serving the best interests of multinational corporations. In addition to opening up markets for multinational corporations, the loans also come with so called technical experts or consultants. So, significant sum of the loans go back to developed countries as salaries of those experts. To get loan from the institutions, a country also has to have a good relationship with the US because it controls 16.77% of total votes in IMF and 16.39% of The World Banks total vote. For instance, N-Korea and Cuba cannot get loans from the institutions because of sour relationship with The US. World Trade Organization (WTO) is another driver of trade liberalization. It forces member countries to open up their markets and eliminate trade barriers. New members are also required to fulfill these criteria. Members are required to comply with intellectual property laws which were mainly written by the big corporations. WTO is widely criticized for being ineffective to protect the interests of developing nations. When trade disputes occur, chance of getting success in legal battle for poor country is very slim even if it has a good ground because the mechanism is so expensive and complicated. Besides, it cannot force developed countries to stop subsidizing agricultural industry because farmers from poor countries are unable to compete with those heavily subsidized farmers in developed countries. Thus, poor countries always have less advantage in global trading system. (VI) Who benefits the most from globalization? There is no doubt that globalized trades/economy benefits all the parties concerned. However, various studies show that advanced countries are benefiting from the trades more than poor countries. Yotpoulos and Romano (2007, P-21) state that free markets and free trade work best if there are supported by extensive institutional structure such as business infrastructures, reliable legal system and political stability. Thus, globalization is more likely to favour the countries which are wealthy and institution rich, at the expense of those that are poor. On the other hand, developing countries with strong infrastructure base, political stability, dependable legal system and abundant labor forces also benefit from globalization. China, India and Vietnam are often cited as ideal examples. Furthermore, United Nation (2007, P-23) asserts that countries with bargaining strength are more likely to benefit more from bilateral trade agreements and impose more onerous terms on the weaker parties. We must ensure that the global market is embedded in broadly shared values and practices that reflect global social needs, and that all the worlds people share the benefits of globalization. Kofi Annan . (VII) Conclusion In short, it is hard to find convincing data to support either globalization reduces or increases poverty. However, it is clear that globalization is more beneficial to developed countries than to developing countries mainly because of wide spread corruption, bad governance, lack of necessary business infrastructures. Unless world leaders share Kofi Annans concern We must ensure that the global market is embedded in broadly shared values and practices that reflect global social needs, and that all the worlds people share the benefits of globalization., the following remarks are unfortunately likely to continue to be true. Significance of the study India opened up the economy in the early nineties following a major crisis that led by a FOREX crunch that dragged the economy close to defaulting on loans. The response was a slew of Domestic and external sector policy measures partly prompted by the immediate needs and partly by the demand of the multilateral organisations. The new policy regime radically pushed forward in favour of a more open and market oriented economy. Major measures initiated as a part of the liberalisation and globalisation strategy in the early nineties included scrapping of the industrial licensing regime, reduction in the number of areas reserved for the public sector, amendment of the monopolies and the restrictive trade practices act, start of the privatisation programme, reduction in tariff rates and change over to market determined exchange rates. Over the years there has been a steady liberalisation of the current account transactions, more and more sectors opened up for foreign direct investments and portfolio investments facilitating entry of foreign investors in telecom, roads, ports, airports, insurance and other major sectors. The Indian tariff rates reduced sharply over the decade from a weighted average of 72.5% in 1991-92 to 24.6 in 1996-97.Though tariff rates went up slowly in the late nineties it touched 35.1% in 2001-02. India is committed to reduced tariff rates. Peak tariff rates are to be reduced to the minimum with a peak rate of 20%, in another 2 years most non-tariff barriers have been dismantled by March 2002, including almost all quantitative restrictions. Globalization has increased poverty, although there is a school of thought that it has reduced poverty. India is Global: The liberalisation of the domestic economy and the increasing integration of India with the global economy have helped step up GDP growth rates, which picked up from 5.6% in 1990-91 to a peak level of 77.8% in 1996-97. Growth rates have slowed down since the country has still bee able to achieve 5-6% growth rate in three of the last six years. Though growth rates has slumped to the lowest level 4.3% in 2002-03 mainly because of the worst droughts in two decades the growth rates are expected to go up close to 70% in 2003-04. A Global comparison shows that India is now the fastest growing just after China. This is major improvement given that India is growth rate in the 1970s was very low at 3% and GDP growth in countries like Brazil, Indonesia, Korea, and Mexico was more than twice that of India. Though Indias average annual growth rate almost doubled in the eighties to 5.9% it was still lower than the growth rate in China, Korea and Indonesia. The pick up in GDP growth has helped improve Indias global position. Consequently Indias position in the global economy has improved from the 8th position in 1991 to 4th place in 2001. When GDP is calculated on a purchasing power parity basis. Globalisation and Poverty: Globalisation in the form of increased integration though trade and investment is an important reason why much progress has been made in reducing poverty and global inequality over recent decades. But it is not the only reason for this often unrecognised progress, good national polices , sound institutions and domestic political stability also matter. Despite this progress, poverty remains one of the most serious international challenges we face up to 1.2 billion of the developing world 4.8 billion people still live in extreme poverty. But the proportion of the world population living in poverty has been steadily declining and since 1980 the absolute number of poor people has stopped rising and appears to have fallen in recent years despite strong population growth in poor countries. If the proportion living in poverty had not fallen since 1987 alone a further 215million people would be living in extreme poverty today. India has to concentrate on five important areas or things to follow to achieve this goal. The areas like technological entrepreneurship, new business openings for small and medium enterprises, importance of quality management, new prospects in rural areas and privatisation of financial institutions. The manufacturing of technology and management of technology are two different significant areas in the country. There will be new prospects in rural India. The growth of Indian economy very much depends upon rural participation in the global race. After implementing the new economic policy the role of villages got its own significance because of its unique outlook and branding methods. For example food processing and packaging are the one of the area where new entrepreneurs can enter into a big way. It may be organised in a collective way with the help of co-operatives to meet the global demand. Understanding the current status of globalisation is necessary for setting course for future. For all nations to reap the full benefits of globalisation it is essential to create a level playing field. President Bushs recent proposal to eliminate all tariffs on all manufactured goods by 2015 will do it. In fact it may exacerbate the prevalent inequalities. According to this proposal, tariffs of 5% or less on all manufactured goods will be eliminated by 2005 and higher than 5% will be lowered to 8%. Starting 2010 the 8% tariffs will be lowered each year until they are eliminated by 2015. GDP Growth rate: The Indian economy is passing through a difficult phase caused by several unfavourable domestic and external developments; Domestic output and Demand conditions were adversely affected by poor performance in agriculture in the past two years. The global economy experienced an overall deceleration and recorded an output growth of 2.4% during the past year growth in real GDP in 2001-02 was 5.4% as per the Economic Survey in 2000-01. The performance in the first quarter of the financial year is5.8% and second quarter is 6.1%. Export and Import: Indias Export and Import in the year 2001-02 was to the extent of 32,572 and 38,362 million respectively. Many Indian companies have started becoming respectable players in the International scene. Agriculture exports account for about 13 to 18% of total annual of annual export of the country. In 2000-01 Agricultural products valued at more than US $ 6million were exported from the country 23% of which was contributed by the marine products alone. Marine products in recent years have emerged as the single largest contributor to the total agricultural export from the country accounting for over one fifth of the total agricultural exports. Cereals (mostly basmati rice and non-basmati rice), oil seeds, tea and coffee are the other prominent products each of which accounts fro nearly 5 to 10% of the countries total agricultural exports. Where does Indian stand in terms of Global Integration? India clearly lags in globalisation. Number of countries have a clear lead among them China, large part of east and far east Asia and eastern Europe. Lets look at a few indicators how much we lag. Over the past decade FDI flows into India have averaged around 0.5% of GDP against 5% for China 5.5% for Brazil. Whereas FDI inflows into China now exceeds US $ 50 billion annually. It is only US $ 4billion in the case of India Consider global trade Indias share of world merchandise exports increased from .05% to .07% over the pat 20 years. Over the same period Chinas share has tripled to almost 4%. Indias share of global trade is similar to that of the Philippines an economy 6 times smaller according to IMF estimates. India under trades by 70-80% given its size, proximity to markets and labour cost advantages. It is interesting to note the remark made last year by Mr. Bimal Jalan, Governor of RBI. Despite all the talk, we are now where ever close being globalised in terms of any commonly used indicator of globalisation. In fact we are one of the least globalised among the major countries however we look at it. As Amartya Sen and many other have pointed out that India, as a geographical, politico-cultural entity has been interacting with the outside world throughout history and still continues to do so. It has to adapt, assimilate and contribute. This goes without saying even as we move into what is called a globalised world which is distinguished from previous eras from by faster travel and communication, greater trade linkages, denting of political and economic sovereignty and greater acceptance of democracy as a way of life. Consequences: The implications of globalisation for a national economy are many. Globalisation has intensified interdependence and competition between economies in the world market. This is reflected in Interdependence in regard to trading in goods and services and in movement of capital. As a result domestic economic developments are not determined entirely by domestic policies and market conditions. Rather, they are influenced by both domestic and international policies and economic conditions. It is thus clear that a globalising economy, while formulating and evaluating its domestic policy cannot afford to ignore the possible actions and reactions of policies and developments in the rest of the world. This constrained the policy option available to the government which implies loss of policy autonomy to some extent, in decision-making at the national level. ~

Introduction The Synthetic Aperture Radar (SAR) is a microwave active imagery system that has been largely used due to its possibility of day-and-night operation in all weather conditions. The SAR system generates images by the coherent processing of the scattering signals; this results in a scene texture that has an undesired multiplicative speckled noise, drastically reduces the ability to distinguish the features of the classes [1]. The rejection of the speckle noise motivated many works where ANN algorithms have been applied to SAR imagery classification [2][3][4][5]. Artificial Neural Network (ANN) algorithms have been increasingly applied to remote sensing for image classification in the last years [6][7][8][9]. SAR images have found many applications in the field of Automatic Target Recognition (ATR). Target detection is a signal processing problem whereby one attempts to detect a stationary target embedded in background clutter while minimizing the false alarm probability. The rapid increase of ANN applications in remote sensing imagery classification is mainly due to their ability to perform equally or more accurately than other classification techniques [10]. Pseudoscience is some form of knowledge, belief or research that claims (or appears) to be scientific, but is not actually following a scientific method.   Peer review and independent research by others may fail to prove the claims.   Superficially, such claims may appear scientific to people. Some of the techniques mentioned in the article that are used by the website to sell their products include:- 1. The research findings or market findings provided by the pseudo-scientists appears to be unprofessional and sloppy.   They may often quote newspaper reports, media coverage, people’s gossip, ancient books, and other pseudoscience books. 2. Pseudoscientists provide facts that emotionally appeal to the audience and provide spectacular results to problems experienced by them.   They may even provide facts to support these results. 3. Pseudoscientists often make people indulge in an irrational form of thinking known as ‘magical thinking’ which is an age-old human habit.   Scientific investigations conducted to prove such facts may be unsuccessful. 4.   Pseudoscientists provide evidence that is different from those provided by systematic studies.   Often a lot of importance is given to unverifiable testimony from people and eyewitnesses, stories, real-life experiences, rumors, gossips, anecdotes, etc.   Studies conducted by professionals are ignored, misinterpreted or even proven wrong. 5. The pseudo scientists do not give reference to previous systematic studies and investigations conducted.   The only give false facts directly, which often cannot be proven right.   They may not allow their claims to be put to a more meaningful test, but may instead suggest some unscientific crazy experiments. The website claims that the tapes can make the individual achieve ‘anything and almost everything’ and ‘As you grow, a series of events occur which build your personality†¦.and your whole self†¦Ã¢â‚¬â„¢Ã‚   The article says that pseudoscientist often make extraordinary claims that may be not scientifically true.   Repeated scientific experiments conducted independently by others fail to prove such clams. They also try to influence the individual by encouraging him/her into magical thinking (belief that one’s thoughts, words or action will create results that will defy the laws of nature).   Magical thinking is an old human habit, and often unknowingly we tend to indulge in it.   Pseudoscience may begin by providing facts that emotionally apply to the audience, and provide spectacular results to people’s problems.   They may even provide evidence to support their results. The Websites claims appreciation from renowned organizations and references such as the Russian Government, CNN, Boston University, etc.   The Russian Government may not be able to monitor implementation of ‘Subliminal messages’, as Private TV channels are free to broadcast what they want.   The website gives a positive comment by CNN. However, it did not give the exact person or the date on which these observations and comments were made.   The article says that pseudo-scientists often quote newspaper articles, press reports, collect rumors and gossips, and may even quote other books or organizations that are false or even non-existent.   The research done by the pseudo-scientists usually appears to be unprofessional and careless. The website gives testimony’s of several ‘satisfied customers’ (as claimed by the company) such as George Montgomery, Philadelphia; Joe Martin, Tampa, Florida; Carole Dallas, Portland; Paul Smiley, Richmond; Sherry Fusco, Bois; etc.   Often pseudo-scientists do not give importance to systematic studies provided by professionals and instead give undue importance to the views and testimony’s from unverifiable customers.   They may not permit their products to be subjected to true scientific studies. The website also offers a one-year guarantee for their products.   The Website has not quoted any proven studies to demonstrate the effectiveness of their products.   Guarantee may be a method of compensating for this (to attract the customers into buying their products). To the nutritionist, its seed is second only to the soybean in nutritional value, and is a source of cooking oil and vitamins. To the paper or cloth manufacturer, it is the plant that provided much of our paper and clothing for hundreds of years and produces four times more fiber per acre than trees. To the environmentalist, it is the plant that could greatly slow deforestation, restore robbed nutrients by other crops, and help prevent erosion. And according to Lonnelle Aikman, "Preliminary findings show the drug may prove effective against glaucoma and asthma, and control such side nausea in cancer treatment" (158). Unfortunately, to most people in this country, it is a useless plant when it comes to economic or medical value. Marijuana should be legalized in the United States. In technical terms, hemp, cannabis, or for the average American, marijuana, it is used only for recre! ational purposes. I think marijuana is a plant that could save the world. In this paper I hope to reverse prejudices, relieve ignorance, and inform people of the known and potential therapeutic uses of this remarkable plant. As of today the nation stands behind three basic ideas of what to do with marijuana; legalize marijuana, make it legal only as a prescription drug, or keep it as it is, illegal. People who are pro-marijuana, argue that marijuana is considerably less harmful than tobacco and alcohol, the most frequently used legal drugs. Furthermore marijuana has never directly caused anyone's death. People who side with the legalization of marijuana for medical purposes believe that the ends justify the means. But the people who want to keep it illegal think that the medical uses do not outweigh the harmful side effects. Before deciding whether marijuana should be legal or illegal, one needs to know some basic facts. Lester Grinspoon, M.D. and James B. Bakalar note "most botanists agree that there are three species of marijuana; Cannabis sativa, the most widespread of the three, is tall, gangly, and loosely branched, growing as high as twenty feet; Cannabis indica is shorter, about three or four feet in height, pyramidal in shape and densely branched; Cannabis ruderalis is about two feet high with few or no branches" (1). They also say that "Cannabis has become one of the most widespread and diversified of plants. It grows as weed and cultivated plant all over the world in a variety of climates and soils" (1). Marijuana was first cultivated in China around 4000 B.C. It was mainly used as a sedative and analgesic, but today it is commonly used for the "high" or the euphoric feeling it causes. The most active ingredient in marijuana is delta-9-tetrahydrocannibinal commonly referred to a! s THC, which wasn't discovered until the 1960s. Marijuana is illegal today because of the Marijuana Stamp Tax Act passed in 1937. This act prohibited the use, sale, and growing of marijuana. It was made illegal because no one understood why smoking marijuana made people feel the way they did, and because it was associated with Indians and other so called "immoral people." Today marijuana is illegal because research has shown some intoxicating effects. Such as hallucination, anxiety, depression, extreme variability of mood, paranoia and schizophrenia lasting up to six hours. Raphael Mechoulam says, "Although cannabis causes initial restlessness, excitement, and sometimes boisterous, impulsive behavior, pacing and dancing, the main picture is of reduced physical activity apart from speech" (316). Physical effects include reddening of the eyes, dryness of the mouth and throat, a moderate increase in heart rate, tightness in the chest, drowsiness, unsteadiness, and uncoordinated muscular contractions. Marijuana buffers ! the central nervous system, but is not known to produce a considerable amount of tar in the lungs. Although marijuana has not been proven to be physically addictive, its use can be psychologically addictive. These are the negative effects of marijuana, and the primary reasons why domestic people, doctors, and politicians want to keep marijuana illegal.
